Hi Folks,

I drove to Indianapolis, IN this weekend for the PRI show and drove back
on Sunday. On the way back I got pulled over by a Michigan State Police
and he charged me with 98Mph in a 70Mph Zone. I am quite upset with
this, as I was going 85 in a 70. (Yeah, I was still speeding) I
explained this to him and he would not even let me get out of my rental
van to see the radar or discuss it with him. He took my Ontario
Driver's License from me and kept it as I did not $100 left in US CASH
to post a bond (I had $93) I am very disappointed and I am not used to
this type of thing in Ontario, CANADA. I just found out that Ontario
has a partner program and this will affect my car insurance and driver's
license in Ontario, Canada.. I'm now very pissed!!!

I really don't want to have to drive back to fight it, as I don't know
if I have a hope in hell of winning.

I was going North on 69, he was South on 69, he must of got me going in
the opposite direction and he corssed the grass quite quickly and
folloed me for a minute of so..
Do I have any chance of getting off this ticket.. Shall I ask for a
court date to prolong this going on my record? What if I don't show-up
to court, will I just get mailed a bill or the ticket and convicted or
will they want to arrest me? I have no idea of MI state laws.. Can
anyone offer any help?

Welcome to the US :) It's a difficult mindset to understand when you're from
Ontario. Pretty much all of North America is hooked up, so any speeding
ticket is going to show up on your record.

I can't offer any advice on fighting it. I've always just paid my tickets as
I've earned every one of them.

just found out that Ontario has a partner program and this will affect my
car insurance and driver's license in Ontario, Canada.. I'm now very
pissed!!!

I really don't want to have to drive back to fight it, as I don't know if I
have a hope in hell of winning...

I'm still quite shocked.. While I deserved something.. I did not earn
the full amount. Only New York and Michigan are hooked up with
Ontario.. I'll remember than next time :-), I'm in the USA quite often
and usually on long drives. I was just surprised he nailed me to the
wall with a big ticket, if I was in Ontario, the cop would have probably
reduce the charge on the spot.. Very different.. I think he figured..
There is no way this guy is coming back to fight it.

In WI (not sure if it applies to MI) the best means to fight a ticket is plead not guilty, then plea bargain out with the D.A. Of course, it usually means that you have to take a driver's ed course, but a lot of times you can get rid of the points, which is key to keeping the insurance down. Not sure if it's worth all that trouble to you though.

If it'd be really bad for you to get a ticket then consider getting a local
lawyer; you may not even have to come back for anything. It'll cost.

I always fight them and generally get some reduction but they just launched
a new enforcement initiative in the face of massive state budget shortfalls
which may not bode well. Good luck.

What a sickening feeling. These are more for local income than highway saf=
ety. It's always best to plead not guilty while you review your options. =
I don't see how they can keep your license! That's outrageous. Can you ge=
t a new copy? I once got a ticket outside of Buffalo. I emailed the court=
asking for the names of lawyers who could represent me. When I got the li=
st I called the court clerk to feel out who did a lot of this work in that =
court. It cost me several hundred but i got the charge reduced.

I fought a ticket in Florida via mail and won. I was in the Navy at the
time, so perhaps it was a courtesy they extended military personnel. But
I didn't have to appear, just filled out a written statement and sent along
a statement from a passenger that was with me... Not sure if this is an
option with MI, but it wouldn't hurt to call and try.

If you can fight it this way, a second statement from a passenger would
likely go a long way...

No matter what go to court.

Plead guilty but ask to give an explanation.

Explain you were in a rental van and there is no way you really believe the=
speed you were charged with.
Explain that is likely that you were exceeding the limit but you find it ha=
rd to believe you were really going as fast as the officer said and that he=
refused to let you see the reading for some reason.

You will get a fine, you will get it on your record but usually they will l=
ower the fine and sometimes the point value of the ticket.

as for asking for the money, i've had it happen in ohio. i've also had to =
surrender my license in ontario once for an infraction. they mailed it bac=
k to me. it's not that uncommon.

Perhaps you can find a mistake on the ticket? That and hiring a lawyer is
the only way I think you'll get out of this.

I showed up in court to oppose a bad ticket (really! we crossed a double
yellow on our bikes and the OHP gave us tickets. It was a parade and as we
got the tickets an entire line of cars needed to do the same.) The OHP
didn't show. Judge made us tell our story. He still gave us points. Before
you are guilty you have a chance to face your accuser, if he doesn't show
the case should be dropped. My experience is a lawyer ($) will be needed to
force the court to play by the rules you want to manipulate.

We don't offer a DE course (I've had my share of tickets). Pray you call a
court date and the cop doesn't show, they toss it out.

FWIW, I sent your mail to a good pal of mine that is a State Trooper, I'll
let you know what he says.. same guy that helped me bring the Sub home at
slightly higher than normal speeds. :)

Also, read the ticket very carefully. Check the date at the top and the
bottom, make sure they are both the right day. Make sure time of
infraction is right, as is all the location info. If he got any of that
wrong, you may get it tossed out on a technicality.

In WI (not sure if it applies to MI) the best means to fight a ticket is
plead not guilty, then plea bargain out with the D.A. Of course, it
usually means that you have to take a driver's ed course, but a lot of
times you can get rid of the points, which is key to keeping the insurance
down. Not sure if it's worth all that trouble to you though.

If it'd be really bad for you to get a ticket then consider getting a local

lawyer; you may not even have to come back for anything. It'll cost.

I always fight them and generally get some reduction but they just launched

a new enforcement initiative in the face of massive state budget shortfalls

which may not bode well. Good luck.

Couple things...

As a Michigander and someone who used to work for state-wide law enforcement (in a computer-related capacity) I can say that the state cops are bad as far as getting off of tickets. Only county sheriffs are worse. Those guys have a real burr up their behind...

If he wrote you up for 98 in a 70, that's a huge ticket and a HUGE fine. In a way you're lucky - more than 15 over the limit is an automatic reckless driving ticket. He could have written you up on that too, but he probably realized he was pushing it already. You don't even want to know what one of those will do to your records and insurance.

If I were you I would get follow a similar course of action - get a lawyer. You don't want the full impact of this ticket to be on your record, even if the lawyer fees amount to more in the short term.

When I convert the 28Mph to KMs (Around 46kms over) and put it on my Ontario
License it is a 4 point ticket.. It is bad, but not deadly! I have a clean
record currently and I'm 26 years old.. Points don't really affect insurance
in Ontario, Canada, it is the number of Minor and Major infractions.. I think
this one might fall into Major.. :(

"Crowding the driver's seat"

I don't get it...the only way I can think of a driver's seat being "crowded" is if the driver is overweight and takes up a lot of space - or is wearing a big fluffy jacket. Can you get a ticket for wearing a big fluffy jacket in Ontario? :-)

When I convert the 28Mph to KMs (Around 46kms over) and put it on my Ontario License it is a 4 point ticket.. It is bad, but not deadly! I have a clean record currently and I'm 26 years old.. Points don't really affect insurance in Ontario, Canada, it is the number of Minor and Major infractions.. I think this one might fall into Major.. :(

I love the 401, both of my race tracks are on the 401.. Sometimes it is hard to
drive the limit in Ontario as everyone drives fast.. You can so 20-25kms over
in Ontario on the highway and you will never get pulled.. If your doing 30kms
over, you will probably get pulled and the cop will knock the ticket down to 15
or 16 over.. Then you goto court and get it knocked down again!!

I love Ontario!!! :) Just don't get caught Street Racing or driving a hopped
up Civic in Metro Toronto or surronding areas, it is worse than been a drug
dealer :)

<P>As far as fighting your ticket in court, I'm 3 for 5 fighting them.&nbsp; Once because calibration on the unit was out of date, once because the officer didnt perform the required accuracy test before he wrote the ticket out and the third time because the judge just didnt like speed traps.&nbsp; One of the times I didn't win was in a small town in south Georgia where the officer "clocked me" using his rearview mirror at 4am.&nbsp; It turned out he was the judge's nephew.&nbsp; Atleast she didn't give me any points and reduced it to 14mph over after finding me guilty.</P>
<P>If its not too far away from your hometown, I'd say go ahead and fight it.&nbsp; It can only help and usually the DA/solicitor will reduce the ammount, the fine or the points if you have a decent driving record.&nbsp; See the National Motorists Association (<A href="motorists.com/">motorists.com/</A>) for some info on how to fight speeding tickets, as well as pertinant info on Michigan laws and lawyers.&nbsp; There are even some book references IIRC.&nbsp; There are many websites on how to beat speeding tickets, try a google search along the lines of "beat speeding ticket."&nbsp; (<A href="speedingticket.net">www.speedingticket.net</A>) also offers a free "e-book" on how to beat speeding tickets, which is suprisingly insightful and almost 100 pages.<BR><BR>What rental van loaded down with all your crap can go&nbsp;100 anyways?&nbsp; You'd need about&nbsp;5 miles of straightaway in all the van's I've ever been in.&nbsp; </P>

I've raced at London's track, and drive the 402/401 to get there.. 140
km/hr or so. ;) I bet in 10 visits to CAN, I've seen a total of 3 OPP
cars... no speed traps, nothin. and you guys have polite drivers! Come up
on someone in the left lane, and they MOVE OVER! Amazing....

I have a pal in Mississauga that got busted in a caravan for 160 km/hr or
so.. there were 7 or 8 cars (F-Bodies), one OPP cruiser bagged them all,
$350ish fine.. ouch.

I love the 401, both of my race tracks are on the 401.. Sometimes it is
hard to
drive the limit in Ontario as everyone drives fast.. You can so 20-25kms
over
in Ontario on the highway and you will never get pulled.. If your doing
30kms
over, you will probably get pulled and the cop will knock the ticket down
to 15
or 16 over.. Then you goto court and get it knocked down again!!

I love Ontario!!! :) Just don't get caught Street Racing or driving a
hopped
up Civic in Metro Toronto or surronding areas, it is worse than been a drug

dealer :)

Was the cop moving in the other direction, or was he sitting in the
median? I believe that most radar systems must be used when stationary and
are invalid otherwise. You may want to look into the law from that angle.

The way the process works is you mail it back as "not guilty" [mail it the
last possible date you can, helps to drag out before points are assessed]
and then they schedule an informal hearing [usually a month to 3 out] with
the Magistrate and the cop and you.. you got any witnesses with you, BTW?
If the cop is a no-show, you win be default [The ONLY way I've won] So, the
magistrate decides guilty or not after hearing both sides. If he/she
shafts you, you still have the legal right to request a formal trial, with
a judge. BUT you pay costs ad crap if you lose. One thing to remember, as
far as I know, is that the points don't get assigned to your license until
you are finally found guilty.. so if you drag out the first 6 months in
this process, you really only have 1.5 years of those points being on the
license, since they are from the date of infraction but not given to you
till guilty... not 100% sure on that, but I believe that is how it works.

Good Grief, where the heck were you when you got busted? You gotta go
almost to Lansing?? Ugh. That's like an hour and half from my house! 481
miles... vs. $176 and 4 points? Tough call. FWIW, there isn't any way to
reduce it with driving schools or anything.. so whatever you walk out with
it what you get.

One thing that might work in your favor (maybe!) is that you are such a
serious racer.. and that you have the clean record.

"Judge, I go 100 on the drag strip, not the highway! I was going with the
flow of traffic [not a legal reason, but it helps if true].. yes, I was
speeding, but not 98!"

Might do you a favor, might seal your fate.. you just never know. :)

As far as fighting it, my experience is its not worth it... I DE, reduced fine, etc... but usually the points stick... I have been without my DL twice in my life and have not rec'd a ticket for 5 years... Knock on wood! I do my speeding on the track!

Atleast she didn't give me any points and reduced it to 14mph over after finding me guilty.

If its not too far away from your hometown, I'd say go ahead and fight it. It can only help and usually the DA/solicitor will reduce the ammount, the fine or the points if you have a decent driving record. See the National Motorists Association (motorists.com/) for some info on how to fight speeding tickets, as well as pertinant info on Michigan laws and lawyers. There are even some book references IIRC. There are many websites on how to beat speeding tickets, try a google search along the lines of "beat speeding ticket." (www.speedingticket.net) also offers a free "e-book" on how to beat speeding tickets, which is suprisingly insightful and almost 100 pages.

What rental van loaded down with all your crap can go 100 anyways? You'd need about 5 miles of straightaway in all the van's I've ever been in.

quickly and folloed me for a minute of so.. Do I have any chance of getting off this ticket.. Shall I ask for a court date to prolong this going on my record? What if I don't show-up to court, will I just get mailed a bill or the ticket and convicted or will they want to arrest me? I have no idea of MI state laws.. Can anyone offer any help?
