By the way...I finally got a speeding ticket

To those of you who cursed me for getting out of my 115 in a 55 zone =
ticket, I FINALLY got a speeding ticket that stuck yesterday. Cruising =
down a winding road on my way to talk to a mechanic friend. I was doing =
70 in a 35 ( its a wide open 4 lane road with no homes or business, the =
35 mph is because of the curves which some people cant handle). I have =
been driving this road for 8 years, and never have I seen a cop.=20
He clocked me at 53 but said I was doing 70 whatever that means? So, he =
was nice ( I guess) and wrote me a ticket for 18 over and the "get out =
of jail free ticket price" of $104.20. I got a kick out of the ticket, =
he noted at the bottom that he clocked me with a "certified calibrated =
radar"...so there goes me pleading not guilty. I can go to traffic =
school if I want, but I dont know if I will or not.
So..there ya go. I'm BUSTED.

Defense... do discovery. They hate that. They usually cannot prepare in
time. Additionally they may let you plead barging.

She can realize that she really *was* guilty and pay the penalty for
breaking the law. Sounds to me like the cop did her a favor for writing her
at 18 over instead of taking her to jail for driving double the limit (which
*can* happen in most states). He quite literally cut her net speed over the
limit in half.
Sometimes honor really *is* the better part of valor

OTOH, she could also go to court, hope the cop shows up and call his bluff
(in her favor of course) that he wrote the ticket for a sped other than what
she was really traveling. It could prove to the court that the cop is
willing to lie and get the entire thing thrown out. Or it could slap her in
the face and she could be penalized for the entire speed...

DO the traffic school!!! I made the mistake a few years back of skipping it
and paying the speeding ticket because I figured I only got a ticket
infrequently enough that it wouldn't be an issue. THEN not 2 months later I
made a left turn in SF at 5pm where there was a sign that I didnt' see that
said no left turn from 8-6pm!!! Guess what, now I had two tickets in one
year and my insurance company started squawking....had I gotten a third I'd
have been in trouble. Do the school....

Guilty or Not, I would oppose the ticket. Why you might ask... Because of
the principal of things. It's not a penalty, its Road Tax, cleverly
disguised.
1. Traffic Citations should be based on a "danger" to public safety not
revenue generation.
2. Speed limits are artificially low.
3. Chances are that Jenn was driving well within her limits.
If you obey speed limits, not because they are prudent, but just because
they are arbitrarily assigned you are just as much at fault. Remember the
good ol' days when 55 MPH was the fastest you could travel without incurring
the wrath of law... Mind you there are go-carts that go faster... but you
better not go that fast on a public highway.
What is needed deperately in this country is better driver training and
education. When we have people driving that do not even know what a contact
patch is, there is a real problem!

Yeah, yeah....and she can learn a lesson from it and not speed any more which
would be best. But can't she learn the lesson at a reduced fee and hopefully

Cat who is trying to remember each day on her 6 - 8 hour commute that those
little pesky signs on the side of the road are not just suggested traveling
velocities! Hey, I've been safe and stay out of harm's (idiot's) way thanks
to the added stopping power of the Porterfields (thanks Bill) and the agility
of the Miata. One thing is for sure, I will watch the speeds more not just
due to tickets but also due to the number of fatalities I've witnessed just
in the past two weeks (8). Somehow I feel a lot safer on the track than on
the highway for my daily commute! Not kidding....and thank goodness I have
the relief of another track event n sight...next Sat.
Jenn, don't ask for trouble. See what is viable in your area and see if you
can plea it down. Methinks you'd be asking for trouble to state your true
speed and question the cop's ethics in court.

Regardless of her abilities or the abilities of her car, there remains a
very simple fact Mark:
The law is written and she agreed to abide by it when she accepted her
drivers license from the state.
I agree with your political statements that these limits are set
arbitrarily, she probably *was* within her limits, and there does need to be
better driver training made available. However, that does NOT negate the
fact that she agreed to abide by the laws when she signed on the dotted
line. She made a conscious decision to break the law, she was caught and she
admits guilt (if not to the court, at least to herself and to us).
Now, if she had been doing 75 down her local freeway in a line of 10 cars
and she was singled out, I would say that she definitely needs to fight it.
I truly feel that a police officer that would stop a single car out of a
line of cars all committing the same offense is discrimination and should be
countered.

Sorry about the Rant... I just get irrate once every 6 months or so about
the illogic surrounding our traffic laws... please forgive me.

Well does that mean if I don't get a license I can speed all I want.
Unfortunately the law is not optional, even if you don't have a license or
registration you would still be suject to the vehicle code.
Now, If driving without a license were not a severe enough offence to get
your car seized (and that is the law in CA) No License... No Car... they
take your car for good!
Anyway back to our regularly scheduled power discussion... I am finally
running 15 PSI on my '99, and it screams... The power is definately up
(although I am running VP Unleaded.) and no knocking, I think it has 4 or 5
PSI of boost left in it!

Well does that mean if I don't get a license I can speed all I want.
Unfortunately the law is not optional, even if you don't have a license or
registration you would still be suject to the vehicle code.
Now, If driving without a license were not a severe enough offence to get
your car seized (and that is the law in CA) No License... No Car... they
take your car for good!
Anyway back to our regularly scheduled power discussion... I am finally
running 15 PSI on my '99, and it screams... The power is definately up
(although I am running VP Unleaded.) and no knocking, I think it has 4 or 5
PSI of boost left in it!

runs a few weeks ago...58 in a 40. This was the first ticket I have
reiceved in the Miata in two years, but the second I have had in the last 3
years. I just decided to pay the ticket...my insurance just got renewed
this month so it won't show up for 6 months there...plus I already pay dirt
cheap insurance in my book.
Good luck if you decide to go to court.

noted at the bottom that he clocked me with a "certified calibrated
radar"...so there goes me pleading not guilty. I can go to traffic school if
I want, but I dont know if I will or not.
So..there ya go. I'm BUSTED.

I think it's safer to assume the worst.
As far as doing the honorable thing - this entire system of laws concerning
speeding is heavily weighted in favor of the municipalities, the law, Big
Brother, the insurance companies, politicians and graft in general. From my
point of view, there is no honor in being "honorable", when what you are
actually doing is joining the conspiracy itself. The truly honorable thing
is to take up the fight and do a better job than the conspirators. They're
out to get you - lying is what they are doing to you. There is nothing
morally wrong with protecting yourself from injustice by using their tactics
and doing a better job than they do. I am *not* a criminal just because some
politician was paid off by an insurance company. They're in bed together and
I will not voluntarily pay for the hotel room.
OTOH, I do not defend those drivers that actually hurt other people through
their own carelessness. In those cases, the law fails again by not being
harsh enough. "No fault" insurance began as a scam and it's now accepted by
most people. Anyone ever hear about the frog in boiling water?

little card with your picture on it? Not to mention the smallish amount of
work necessary to actually get the thing. Now we are older? and more
experienced. Maybe we should get a get a pass or something on experience
alone. Natural selection is ruined by air bags.
"The License" I believe is no reason to not use the "judgmental" system,
anyway you can.

a non-profit organization called The National
Motorists Association that is dedicated to
repersenting motorists rights. Here is there mission
statement:
"The National Motorists Association is a membership
organization devoted to representing and protecting
the rights and interests of North American motorists."

Memebership is nominal, adn you get a pretty cool
little news letter with traffic and motorist
information.
Questions can be RTP.
(I get nothing out of this, I just like the idea of
people interested in helping fight the war of
rediculous traffic laws in this country)
